Inhalt:

With the establishment of the "Internet of Things and Services", many areas of life are determined by data processing. The ubiquitous and constantly evolving level of digitalization

in everyday life also favors the emergence of Big Data and the use of data mining. Against this background, data protection law has recently been established on various legal levels.

The aim of the lecture is to comprehensively address data protection law in international, European and German law and to show the relationship between its international

establishment and European and German developments. In addition to the history of data protection, the foundations, sources of law and basic principles in the multi-level system,

special attention will be paid to the right to protection of personal data in the context of fundamental and human rights, also against the background of relevant case law. The

question of the need for better data protection by State actors is addressed. Last but not least, data protection law is presented from the perspective of its cross-border significance

in specific areas such as medical research, the use of online services and social media, and the fight against terrorism. The consideration of information-theoretical and -ontological

basics as well as technological developments such as cloud computing complement the course with interdisciplinary traits.

Inhalt:

This seminar deals with recent technical and legal challenges of artificial intelligence (AI), especially in

medicine and natural sciences. Target audience are students of law, natural sciences and

engineering, but students of other disciplines are also cordially invited. The seminar fosters cross-

disciplinary dialogue on the technical potential and normative limits that enable the transparent and

fair use of AI for the benefit of society.

In order to promote a comprehensive discourse, subjects will be examined from both a scientific-

technical and a prescriptive-legal angle. The main focus is on the quality assurance of training data,

risk minimisation and the prevention of bias, particularly in a medical context. By combining technical

and legal approaches, the aim is to develop a holistic understanding of the opportunities and

challenges of AI.

Inhalt:

Data and information serve as the basis for administrative action and administrative decisions. The development of the administration into an information and

communication network means that public authorities can increasingly profile themselves as users of the growing availability of data, both as an opportunity

and as a prerequisite for their actions and decisions. In this role, public authorities are addressees of data protection regulations, as they process personal data

as controllers or processors. On the one hand, the application of data protection provisions requires organizational measures, and on the other hand, the general

data protection regulation of the EU was recently expanded to include sector-specific regulations on the processing of personal data. In particular, these new,

diverse EU legal requirements create new administrative actors who are entrusted with various legal options and obligations for processing personal data in

compliance with data protection law.

In addition, the administrative actors are not only the addressees of data protection regulations, but also monitor whether private bodies comply with data

protection regulations. The introduction of these new players represents both a challenge for the increase in the number of authorities and supervisory structures

as well as a development potential for the further differentiation of cooperation networks in the European administrative network. Their structuring, the definition

and delimitation of their responsibilities, powers, tasks and cooperation is a complex issue of administrative organization. Cross-border networking and

cooperation between administrative authorities is at the heart of the creation of European data spaces.

The course will examine these issues using the example of recent developments in European legislation on digitalization with a particular focus on the healthcare

sector. The course invites students who are interested in various legal disciplines. In addition to classic administrative law topics such as administrative organization

law, criminal law and international law references will also be examined.

Inhalt:

Gegenstand der Vorlesung ist die Systematik und Entwicklung des internationalen Menschenrechtsschutzes. Dabei soll ein Überblick zu den verschiedenen

Rechtsquellen des Menschenrechtsschutzes gegeben werden, insbesondere zur Allgemeinen Erklärung der Menschenrechte, zum Internationalen Pakt über

bürgerliche und politische Rechte, zum Internationalen Pakt über wirtschaftliche, soziale und kulturelle Rechte und zur Europäischen Menschenrechtskonvention.  

Darüber hinaus wird ein Überblick über sektorspezifische und regionale Konventionen dargestellt.

 

Die verschiedenen Systeme des Menschenrechtsschutzes werden zueinander in Beziehung gesetzt. Zudem wird ihr Verhältnis zu nationalen und europäischen

Grundrechtsnormen erörtert. Ihre prozessuale und politische Durchsetzbarkeit wird ebenso thematisiert wie ihre allgemeine Bedeutung für Rechtsstaatlichkeit

und internationale Ordnung.

The lecture covers the systematics and development of international human rights protection. It provides an overview of the various legal sources of human rights protection, in

particular the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights,

and the European Convention on Human Rights.   In addition, an overview of sector-specific and regional conventions will be presented.

 

The various systems of human rights protection will be compared and contrasted. Their relationship to national and European fundamental rights standards will also be discussed.

Their procedural and political enforceability will be addressed, as will their general significance for the rule of law and international order.
